A 'Simple Majority Vote'
"Democracy is more complex than simply winning by a majority vote. A simple majority vote may work on school playgrounds - where the issue is whether to play kickball or baseball, but it does not work and is not permitted under our Constitution, where the amendment strips a 'disliked' minority of important rights such as the right to marry."

In light of Measure 36 being upheld, I have a question to ask...What if Nashif and his ilk gather enough signatures on a petition to ban any union [civil unions, domestic partnerships etc.] between 2 men or 2 women? Where do we go from there? I am also writing this believe gay people in Oregon are going to be up the creek again by not taking a more offensive stance on gay unions. It won't matter if we have all branches of the state government democratic, if the wingnuts get another constitutional ammendment or law banning us from contracting into a union or partnership then we will have a huge uphill climb out of the pit that they will throw us in.

I am pretty confident that a constitutional amendment--AGAIN--banning civil unions/domestic partnerships would not pass based on statewide polling that was done. There was over 65% support for civil unions. Then again, polls have flaws. If our side were to pursue a ballot measure as an offensive move, and we lost--we'd be screwed.
So on the 'offensive' note. It's coming... I promise.
